The Supreme Court was considering a petition Kapoor filed to overturn the arrest warrants that had been issued against her for allegedly disrespecting soldiers and offending their families.
The producer of the web series "XXX," Ekta Kapoor, was reprimanded by the Supreme Court during the hearing for having "objectionable content" and for corrupting the brains of India's youth. When the court heard her appeal to overturn the producer's arrest warrant for allegedly disrespecting soldiers and harming their families in a web series that aired on her OTT platform, ALT Balaji, it made these scathing comments.
"It is accessible to everyone, OTT (Over The Top) stuff is accessible to everyone, what kind of choice are you presenting to the people, on the contrary, you are contaminating the minds of young people", declared a bench of Justices Ajay Rastogi and C. remarked T. Ravikumar.
In the highest court, senior attorney Mukul Rohatgi argued on behalf of Kapoor that although the Patna high court has been notified of the case, a hearing is not anticipated anytime soon.
Given that there is freedom of choice in the nation and that the content on the OTT platform is subscription-based, the court questioned what type of choice is offered to the people.
"Every time you travel to this court....we don't appreciate this. We will put a cost on you for filing such a petition. Mr Rohatgi, please convey this to your client. Just because you can afford and hire the services of good lawyers....this court is not for those who have voices.
"This court works for those who don't have voices...if these people who have all kinds of facilities if they cannot get justice then think of the situation of this common man. We have seen the order and we have our reservations," the bench observed.
The court decided to keep the appeal on hold for the time being and recommended that a local attorney be appointed to inquire about the appeal's status with the relevant high court.
A trial court in the Bihar district of Begusarai issued an arrest warrant for Kapoor following a complaint by ex-serviceman Shambhu Kumar.
In 2018, Ken Ghosh created the sensual comedy-drama web series XXX in Hindi for the ALT Balaji video-on-demand service. In addition to Aparnaa Bajpai, Rithvik Dhanjani, Shantanu Maheshwari, Ankit Gera, Pryanca Talukdar, and Aparna Sharma, Kyra Dutt also appears in the film.
The intended movie's principal photography started in April 2015, and its release was slated for 2016, however, because of censorship concerns, it would instead be made available as a web series on the website Alt Balaji on September 27, 2018. On September 20, 2018, the trailer was made available.
This programme was also available on Zee 5, but after Sampoorn Rishta and numerous other episodes were exposed for containing nudity, Zee 5 removed the programme from their OTT service.
